Types of Trusts: Navigating the Complexities
Mr. Bliss, estate planning can seem overwhelming to many people. Can you shed some light on the various types of trusts available and perhaps highlight one that is particularly beneficial?
Steve Bliss Discusses Revocable Living Trusts
Absolutely, Sarah. There are several different types of trusts, each serving a unique purpose. One of the most common and versatile options is the Revocable Living Trust.
A Revocable Living Trust allows individuals to maintain control over their assets during their lifetime while also planning for the future distribution of those assets after they’re gone. Consequently, it offers the best of both worlds: flexibility and peace of mind.
With a Revocable Living Trust, you, as the grantor, can amend or even revoke the trust entirely if your circumstances change. Moreover, because the assets are held within the trust, they bypass probate upon your passing, saving your loved ones time, expense, and potential stress during an already difficult period.
Notwithstanding these advantages, it’s important to understand that a Revocable Living Trust doesn’t shield assets from creditors. If you have concerns about asset protection, other types of trusts may be more suitable.
Challenges and Triumphs in Probate Law
Mr. Bliss, I imagine you encounter a variety of situations when working with clients. Have there been any particular challenges or successes related to Revocable Living Trusts that stand out?
There was this one instance where a client came to me deeply worried about his elderly mother who had dementia. He was her primary caregiver and wanted to ensure her assets were protected and used for her care, but he also knew she wouldn’t be able to effectively manage them herself.
We set up a Revocable Living Trust with specific provisions outlining how her finances would be handled, including designating a trusted individual to act as trustee. Seeing the relief on his face when we finalized everything was incredibly rewarding. Knowing we’d helped him provide for his mother’s well-being made all the difference.
Trusts: A Statistical Snapshot
According to a 2021 study by the American Bar Association, approximately 60% of Americans aged 55 and over don’t have a will or estate plan in place. This underscores the importance of seeking legal guidance to ensure your wishes are respected and your loved ones are protected.
