Protecting Our Elders: A Conversation with Ted Cook

Today I’m sitting down with Ted Cook, an elder protection attorney here in beautiful San Diego. Ted, thanks for taking the time to chat with me today.

What Inspired You to Focus on Elder Protection Law?

Well, I’ve always been drawn to helping vulnerable populations. As I gained experience in law, I realized that seniors are often targets of abuse and exploitation, and they need strong advocates to protect their rights. It’s incredibly rewarding work knowing that you’re making a real difference in someone’s life during a challenging time.

Can You Walk Us Through the Typical Steps Involved in an Elder Protection Case?

  • Initial Client Engagement
  • Case Assessment
  • Protective Actions
  • Legal Proceedings
  • Long-Term Planning
  • Case Resolution & Follow-Up

Let’s Focus on “Protective Actions.” Can You Elaborate on What That Entails?

Absolutely. “Protective Actions” is where we really start taking concrete steps to safeguard the elder. Depending on the situation, this could involve several different measures. Sometimes it’s about getting a restraining order against an abusive family member or caregiver. Other times, it might mean freezing bank accounts to prevent financial exploitation. We also work with Adult Protective Services (APS) and can petition for guardianship or conservatorship if necessary to ensure the elder’s well-being is protected.

We had a case recently where an elderly gentleman was being financially manipulated by someone posing as his “friend.” This person convinced him to withdraw large sums of money, leading to significant financial losses. We were able to intervene, freeze his accounts, and ultimately recover some of the stolen funds. It’s crucial to act quickly in these situations to minimize damage.
