Certainly. One crucial step is what we call “Marshaling the Estate Assets.” This involves creating a thorough inventory of all assets belonging to the deceased individual. It includes bank accounts, real estate, vehicles, investments – essentially anything of value.
Ordinarily, this process begins after the court appoints an executor or administrator. They then have the responsibility of locating and documenting each asset. It’s important to remember that probate assets are those that are not specifically directed to a beneficiary outside of probate through tools like trusts or joint tenancy.
Once all the assets are identified, we file an Inventory and Appraisal with the court. This document provides a detailed list of each asset along with its estimated value. It serves as a transparent record for both the court and the beneficiaries, ensuring everyone is aware of what’s included in the estate.
I remember one case where a client had a hidden safe deposit box containing valuable jewelry. Had we not diligently searched for all potential assets, those items would have been overlooked. Consequently, taking the time to thoroughly marshal the estate assets is vital for ensuring a fair and complete distribution to the rightful heirs.
The California Probate Code specifically outlines the requirements for this step, further emphasizing its importance in the probate process.

While most cases proceed smoothly, I once encountered a situation where locating certain assets proved particularly difficult. The deceased individual had numerous investments spread across different brokerage accounts. Tracking them all down required significant effort and collaboration with various financial institutions.
Nevertheless, we persevered, meticulously reviewing account statements and contacting brokers until every asset was accounted for. This experience highlighted the importance of organization and thoroughness in estate planning. Having clear records and readily accessible information can greatly simplify the probate process for loved ones left behind.
