Special Needs Trusts help protect assets for beneficiaries with disabilities without jeopardizing their eligibility for government assistance.

  • Asset Protection Trusts aim to shield assets from creditors, though California law limits their effectiveness.
  • Qualified Personal Residence Trusts allow homeowners to transfer their residence out of their estate while retaining the right to live there for a set period.
  • Life Insurance Trusts own life insurance policies, keeping proceeds outside of the taxable estate.
  • Spendthrift Trusts protect beneficiaries from themselves and creditors by controlling how and when funds are distributed.

Finally, Grantor Retained Annuity Trusts are used for wealth transfer with minimal gift tax consequences.

Can you delve into the specifics of a Special Needs Trust and why it’s so important?

Special Needs Trusts are crucial for individuals with disabilities because they allow them to receive financial support without jeopardizing their eligibility for vital government benefits like Supplemental Security Income (SSI) or Medi-Cal.

Ordinarily, inheriting assets directly could disqualify someone from these programs. A Special Needs Trust acts as a safety net, ensuring that the beneficiary’s needs are met while preserving their access to essential healthcare and financial assistance.

I recall one case where a young woman with cerebral palsy inherited a significant sum of money. Without a Special Needs Trust, her benefits would have been terminated, leaving her in a precarious situation. We established a trust that allowed her to use the funds for supplemental care, assistive technology, and enriching experiences without affecting her government support.

It was incredibly rewarding to see how the trust empowered her to live a more fulfilling life.
